1. About These Terms

This website is operated by Mother's Gleam, a trading name of Tino Group, a sole proprietorship (eenmanszaak) registered with the Dutch Chamber of Commerce (KvK) under number 42079976, VAT number NL005478900B20. Throughout this site, "we," "us," and "our" refer to Mother's Gleam. By visiting our site, subscribing to our newsletter, or purchasing any product from us, you agree to be bound by these Terms of Service ("Terms"), along with any additional policies referenced here.

Please read these Terms carefully. If you do not agree with any part of them, you may not use our website or services.

We may update these Terms from time to time. Continued use of the site after changes are posted means you accept the revised Terms. The current version is always available on this page.

2. Newsletter Subscription & Promotions

By subscribing to our newsletter, you consent to receive marketing emails from Mother's Gleam, including product updates, exclusive offers, and discount codes. You may unsubscribe at any time using the link at the bottom of any email.

Where a subscription is linked to a promotional giveaway (such as a gift card draw), participation is voluntary, no purchase is necessary to enter, and odds of winning depend on the number of eligible entries. We reserve the right to verify eligibility and to disqualify entries obtained through fraudulent means. Winners will be notified via the email address provided at signup.

3. Eligibility

You must be at least 16 years old, or the age of legal majority in your jurisdiction, to create an account, subscribe to our newsletter, or place an order. By using our site, you confirm that you meet this requirement.

4. Products & Cleaning Tools

Mother's Gleam sells reusable cleaning tools, including but not limited to microfiber cloths, mops, scrubbers, brushes, squeegees, and cleaning accessories. Please note the following:

Use and surfaces. Product pages describe what each tool is designed for. Surfaces and finishes vary, so we recommend testing a tool on a small, hidden area before first use, particularly on delicate, coated, or polished surfaces. We are not responsible for damage resulting from use on unsuitable surfaces or from use other than as described.

Safety and care. Always follow the care, charging, and safety instructions supplied with your product. Keep cleaning tools, and especially battery-powered tools, out of reach of children, and do not use a product that is damaged.

Materials. Product listings include material information where relevant. If you have specific sensitivities to certain materials, please check the product information before use.

Intended use. Our products are designed for household cleaning only and should not be used for any other purpose.

Product recalls. In the rare event of a safety recall, we will notify affected customers via the email or contact information on file and provide instructions for return, replacement, or refund.

5. Orders & Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or stock unavailability. Prices are listed in USD and are subject to change without notice, though changes will not affect orders already confirmed.

6. Shipping & Returns

Shipping timeframes and costs are provided at checkout. For hygiene reasons, used items (such as cloths, pads, brushes, or mop heads that have been used for cleaning) are not eligible for a change-of-mind return. Please refer to our separate Return Policy for full details.

We do not have a fixed return address. If there is a problem with your order and you would like to return it, you must first submit a return request through the order's return process (Orders → Disputes → Return). Once your request has been approved, our team will provide the return address available for that order.

7. Disclaimer of Warranties

Our products and this website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be excluded by law. We do not guarantee that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Pricing & Typographical Errors

We make every effort to display accurate pricing and product information. However, in the event of a pricing error, typographical error, or other mistake in a product listing, we reserve the right to refuse or cancel any order placed based on the incorrect information, whether or not the order has been confirmed. If you have already been charged, you will receive a full refund.

9. Third-Party Links & Tools

Our site may contain links to third-party websites or make use of third-party tools (such as payment processors, review platforms, or shipping carriers) that are not owned or controlled by Mother's Gleam. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of such third-party tools is at your own risk and subject to their respective terms.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mother's Gleam, its owners, employees, and affiliates from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your misuse of our products, your breach of these Terms, or your violation of any law or the rights of a third party. This includes, without limitation, claims arising from use of our products on unsuitable surfaces or failure to follow provided use, care, charging, or safety instructions.

11. Force Majeure

Mother's Gleam shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, labor disputes, supply chain disruptions, acts of government, or other events of force majeure.

12. Complaints Procedure

If you have a complaint about a product or your experience with Mother's Gleam, please contact us at mothersgleam@gmail.com with your order number and a description of the issue. We aim to acknowledge complaints within a reasonable timeframe and work toward a fair resolution. This does not affect any statutory right you may have to escalate a complaint to a relevant consumer authority or dispute resolution body in your jurisdiction.

13. Account Termination

We reserve the right to suspend or terminate your access to the site or any account, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused our services.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

15. Entire Agreement

These Terms of Service, together with any policies or documents expressly referenced herein (such as our Privacy Policy and Return Policy), constitute the entire agreement between you and Mother's Gleam and supersedes any prior agreements or understandings, whether written or oral, relating to your use of the site.

16. Intellectual Property

All content on this site, including text, graphics, logos, product photography, and design, is the property of Mother's Gleam or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use this content without our written permission.

17. User Conduct

You agree not to use this site for any unlawful purpose, to submit false information, or to interfere with the site's security or functionality.

18. Limitation of Liability

To the fullest extent permitted by law, Mother's Gleam shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website, including any damage to surfaces or property resulting from misuse or failure to follow instructions. Our total liability in connection with any order shall not exceed the amount paid for that order. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law (for example, liability for death or personal injury caused by negligence, or liability that cannot be excluded under mandatory consumer protection law).

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the competent courts of the Netherlands, to the extent permitted by applicable law. If your local consumer protection law requires disputes to be resolved under local law, this section applies only to the extent it does not conflict with that law.
